Construction & Real Estate Contracts

As contract experts, we assist our clients with various agreements, including construction contracts, purchase and sale or lease agreements, and subcontractor agreements, just to name a few.

Mechanic’s Liens

Unfortunately, collections on construction projects often involve the need to draft and file a [notice of a] mechanic’s lien affidavit, or deal with one being filed against your property. Our real estate attorneys routinely advise clients on the complicated rules associated with mechanic’s lien claims, and draft the required notices and affidavits. If needed, we also perfect claims and recover on the liens for our clients. Additionally, we often dispute invalid liens.

Construction Litigation and Dispute Resolution

Lawsuits cannot always be avoided, and when the need arises, we also represent clients in real estate and construction disputes in arbitration, trials, and on appeal. While Thomas & Sawyer, PLLC always prefers to avoid or limit litigation, oftentimes disputes can only be resolved through trial or some form of dispute resolution. Various types of real estate litigation cases we handle include:

  • Construction defects
  • Breach of contract
  • Lien and bond claims
  • Warranty claims
  • Change order disputes
  • Delay claims
  • Insurance claims
